    Hi Paul and Willi,
    I include farther below the text after Paul´s comments.
    Paul,
    1) I have kept the word “via” within the hyphenated clause because prior informed consent, mutually agreed terms and some amount of benefit sharing are, the three o them the instruments, ways, mechanisms…through which the conditions for access must be materialized. They are the processes (BS, although more substantive than procedural, is also a condition to be negotiated) that the sovereign country restricting access needs to use.
    2) the acronym is ABS refers to ALL the content of the regulation, i.e., the right (to access genetic resources) and the main condition for that right to be exercised (benefit sharing) but since in the hyphenated phrase we are enumerating only the conditions for access grammatically we cannot repeat the word access within the hyphens; it is only the benefit sharing what is the condition. Nevertheless we could maintain the acronym ABS due to its well known use … –besides the autovehicles´ breaking system. See both alternatives in brackets below, and choose what you might find best.
    The text would read, with all these elements, as follows:
    Based on the sovereign rights of States over their natural resources under the international legal requirements of the Convention of Biological Diversity of 1992 and its Nagoya Protocol of 2010, the authority to determine access to genetic resources rests with the national governments and is subject to national legislation. This legislation should, nevertheless, create conditions –via prior informed consent (PIC), mutually agreed terms (MAT) and benefit sharing [(ABS)]or [(BS)]- to facilitate access for environmentally sound uses and not impose restrictions that run counter to the conservation and sustainable use of biodiversity.This potential restriction applies equally to the physical “genetic resources” and to the genetic data about them.

    This is important and very well stated, Enrique. I also will cross-reference it in #7 and perhaps it should be given as an example of total Harmonization in #4. However, I would make a few additions here.
    – In the end of the first sentence add: “,based on the international legal requirements of the Convention of Biological Diversity of 1992 and its Nagoya Protocol of 2010.” It is essential for these two primary legal documents to be referenced and linked to in the text.
    – In addition to PIC and MAT in the middle of the hyphenated clause in the last sentence is ABS (access and benefit sharing) as a term of art in that legal regime. The hyphenated clause thus should read::
    “– prior informed consent (PIC), mutually agreed terms (MAT), and access and benefit sharing (ABS)–” (Note: the “previous” should be “prior”, add the “access and”, and all three acronyms for consistency of the terms and familiarity).
    – Finally, I would add a short sentence at the end of the paragraph as follows:
    “The laws apply equally to the physical “genetic resources” and to the genetic data about them.”
    Otherwise, the applicability of this text to the data (as opposed to just the physical materials) is unclear.
