Hello Everyone
Thank you for the article it's an interesting one indeed. As some of you may know I am a researcher on the european project called FutureTDM that looks at the barriers to text-and datamining one of which has to to with the legal framework.
I do not agree with Mr Band that no one has ever got into trouble for doing Himmelstein's kind of project. It depends on your definition of 'trouble' but I have come across researchers who have been blocked by publishers for example and gotten into trouble with their university management over this. For FutureTDM I am working on finding evidence/examples and to propose recommendation.
I was wondering if this topic is of interest to RDA and if perhaps anyone would be interested to help propose a BoF ( if I am not mistaken there is nothing specific on this issue yet). It would be very helpfull for our research to provide the EC case studies and a RDA endorsed statement maybe ?

Hi Freyja,
Jonathan Band, in the article, is referring specifically to "legal penalties" when talking about getting into trouble. You are right that *trouble* is in the eye of the beholder (and the recipient) but legal penalties are in the eyes of the law. Publishers can harass researchers but that doesn't mean the researchers are necessarily breaking the law. Just keep that distinction in mind when collecting examples.
